Terms of Service

1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the services provided by Maple Bloom Garden Co. (“Maple Bloom Garden Co.,” “we,” “us,” or “our”), located at 1250 Sheppard Ave E, Toronto, ON M2K 1E8, Canada. By requesting, scheduling, paying for, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms apply to all customers, property owners, tenants, authorized representatives, and any other persons who engage Maple Bloom Garden Co. for garden and landscaping-related services.
2. Scope of Services
Maple Bloom Garden Co. provides garden and outdoor property maintenance services, which may include, without limitation:
- Garden design and planting plans;
- Lawn care and seasonal maintenance;
- Tree, shrub, and hedge trimming;
- Mulching and soil improvement;
- Weed control and bed cleanup;
- Irrigation system checks and adjustments;
- Spring and fall garden cleanups.
All services are subject to site conditions, weather, seasonal availability, plant health, safety considerations, and any applicable municipal, provincial, or federal laws and regulations. We may refuse, suspend, or modify services where conditions are unsafe, unlawful, or otherwise unsuitable.
Any estimates, recommendations, or planting plans provided by us are based on information available at the time and are not guarantees of specific outcomes, growth rates, bloom cycles, pest resistance, or long-term plant survival.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and current information when requesting services;
- Ensure that you have the legal right, authority, or permission to request services for the property;
- Disclose all known hazards, including underground utilities, irrigation lines, drainage issues, unstable structures, pest infestations, toxic plants, protected species, and any other site-specific risks;
- Obtain any required permissions, permits, approvals, or consents from landlords, condominium boards, municipalities, or other third parties;
- Secure pets, children, valuables, and fragile items before service begins;
- Provide reasonable access to the property, water, electricity, and any other necessary utilities unless otherwise agreed in writing;
- Promptly review completed work and notify us of any concerns within a reasonable time;
- Comply with all instructions and safety guidance provided by Maple Bloom Garden Co.
You are responsible for identifying and protecting any items or conditions that may be damaged by normal gardening operations, including but not limited to sprinkler heads, buried cables, decorative lighting, edging, irrigation components, and sensitive plantings.
4. Payment Terms and Conditions
Unless otherwise agreed in writing, fees for services are due in accordance with the invoice terms provided by Maple Bloom Garden Co. We may require a deposit, advance payment, or payment upon completion depending on the nature and scope of the work.
- All prices are stated in Canadian dollars unless otherwise indicated.
- Applicable taxes, including HST or other sales taxes, will be added where required by law.
- Estimates are based on the information available at the time and may be adjusted if the scope of work changes, site conditions differ materially, or additional labor, materials, or equipment are required.
- Late payments may be subject to interest, administrative charges, collection costs, or service suspension to the extent permitted by law.
- You are responsible for all charges related to approved materials, disposal fees, special equipment, and third-party services unless otherwise stated in writing.
If a payment is declined, reversed, or disputed without valid cause, we may suspend future services until the account is brought current.
5. Cancellation and Refund Policy
You may cancel a scheduled service by providing reasonable notice. Cancellations made with insufficient notice may be subject to a cancellation fee to cover scheduling, labor, travel, or preparation costs, to the extent permitted by law.
If Maple Bloom Garden Co. must cancel or reschedule due to weather, safety concerns, equipment failure, staff availability, or other operational reasons, we will make reasonable efforts to offer an alternative date or time.
Refunds, if any, are issued only at our discretion or where required by applicable law. Completed services are generally non-refundable. Materials that have been specially ordered, customized, or installed may not be refundable unless required by law or expressly agreed in writing.
If you request a refund or dispute a charge, you must provide a written explanation and any supporting information. We will review the matter in good faith and respond within a reasonable time.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Bloom Garden Co. shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of enjoyment, loss of use, loss of data, or loss of plant material resulting from conditions beyond our reasonable control.
Without limiting the foregoing, we are not responsible for:
- Pre-existing property damage, soil conditions, drainage issues, disease, pests, drought, frost, flooding, or extreme weather;
- Damage caused by hidden or undisclosed utilities, irrigation systems, underground structures, or other concealed hazards;
- Plant failure due to improper care, neglect, vandalism, animal damage, or environmental conditions after service completion;
- Delays or failures caused by third parties, suppliers, municipal restrictions, or force majeure events;
- Any loss arising from your failure to provide accurate information or timely instructions.
Where liability cannot be excluded under applicable law, the total aggregate liability of Maple Bloom Garden Co. for any claim arising out of or relating to the services shall be limited to the amount paid by you for the specific service giving rise to the claim, to the extent permitted by law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for gross negligence, wilful misconduct, or any other liability that cannot lawfully be excluded.
7. Intellectual Property Rights
Unless otherwise agreed in writing, all content, concepts, designs, drawings, planting plans, estimates, proposals, photographs, text, and other materials created or provided by Maple Bloom Garden Co. remain our property or the property of our licensors and are protected by applicable intellectual property laws.
Upon full payment, you receive a limited, non-exclusive, non-transferable license to use any garden design or planting plan we provide solely for the property and purpose for which it was created. You may not reproduce, distribute, sell, publish, or use our materials for other properties or commercial purposes without our prior written consent.
You grant Maple Bloom Garden Co. a non-exclusive right to use photographs or descriptions of completed work for portfolio, marketing, training, and promotional purposes, provided that we do not disclose your personal information in a manner contrary to applicable privacy laws or any written confidentiality agreement.
8. Data Protection and Privacy
Maple Bloom Garden Co. collects, uses, stores, and discloses personal information only as necessary to provide services, manage customer relationships, process payments, comply with legal obligations, and improve our operations, in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable.
Personal information may include your name, address, contact details, service preferences, payment information, property access instructions, and service history. We take reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, loss, misuse, or disclosure.
We may share personal information with trusted service providers, payment processors, contractors, or legal/regulatory authorities when necessary and permitted by law. We do not sell personal information.
By using our services, you consent to the collection, use, and disclosure of your personal information as described in these Terms and in any applicable privacy notice we may provide. If you provide information about another person, you represent that you have the authority to do so and that you have informed them as required by law.
9. Force Majeure
Maple Bloom Garden Co. shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to severe weather, storms, flooding, wildfire, ice, acts of God, labour disputes, supply shortages, transportation interruptions, power outages, equipment failures, public health emergencies, government orders, or other similar events.
During a force majeure event, our obligations will be suspended for the duration of the event and we will resume performance as soon as reasonably practicable.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be effective upon posting or upon notice to you, as applicable.
Your continued use of our services after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the services shall be brought exclusively in the courts located in Toronto, Ontario, Canada, and you consent to the personal jurisdiction and venue of those courts, except where applicable law requires otherwise.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Any failure by Maple Bloom Garden Co. to enforce a right or provision under these Terms shall not constitute a waiver of that right or provision unless expressly stated in writing.
By requesting or using the services of Maple Bloom Garden Co., you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
